The Lagos Victim’s Assistance and Witness Protection Law 2024
In 2024, Lagos State enacted the Victim’s Assistance and Witness Protection Law — a landmark piece of legislation that grants crime victims a set of enforceable rights within the criminal justice system. Here is what that law means for you, in plain terms:
- The Right to be Informed: You have the right to be kept updated about the progress of your case, including any arrest, charge, bail, or release of the accused.
- The Right to be Protected: If your safety is at risk — for instance, if you fear the accused or their associates — you can apply for protective measures including witness protection.
- The Right to Participate: You have the right to formally engage with the court process and to be kept informed of key decisions made in your case.
- The Right to Compensation: You may be entitled to compensation from the state or from the offender, depending on the circumstances of your case.
- The Right to Support Services: You are entitled to referral to appropriate support services, including medical care, psychological counselling, and legal assistance.
- The Right to Dignity: You must be treated with respect, fairness, and sensitivity throughout all interactions with the criminal justice system.
The Administration of Criminal Justice Law (Amendment) 2021
Alongside the Victim’s Assistance Law, the Lagos Administration of Criminal Justice (Amendment) Law 2021 sets out procedural protections for victims. These include the right not to be unnecessarily detained or interrogated without access to legal representation, and protections governing how your testimony is received by the court.
